Call to Order and Roll Call.

ITEM NO. 1 Invocation - the McCook Ministerial Association.
ITEM NO. 2 Citizen’s Forum.

ITEM NO. 3 Mayor’s Announcements & Recognitions.
ITEM NO.  4  Public Hearings:
ITEM A  Public Hearing - request for a special exception to construct a Personal Wireless Facility at a height limit of one hundred feet (100') in a Residential Medium Density (RM) District; on a parcel located in the Southeast Quarter of the Northeast Quarter (SEĽNEĽ) of Section Nineteen (19), Township Three (3) North, Range Twenty-Nine (29) West of the 6th P.M., McCook, Red Willow County, proposed lot being 150' x 150'; applicant - NE Colorado Cellular, Inc., dba "Viaero Wireless".
ITEM B  Approve request for a special exception to construct a Personal Wireless Facility at a height limit of one hundred feet (100') in a Residential Medium Density (RM) District; on a parcel located in the Southeast Quarter of the Northeast Quarter (SEĽNEĽ) of Section Nineteen (19), Township Three (3) North, Range Twenty-Nine (29) West of the 6th P.M., McCook, Red Willow County, proposed lot being 150' x 150'; applicant - NE Colorado Cellular, Inc., dba "Viaero Wireless"; that the granting of the special exception will not adversely affect the public interest; and that satisfactory provisions and arrangements have been made by the applicant concerning Special Exception Considerations a - h
ITEM C Public Hearing - consider the final plat of a subdivision of a tract of land being part of the Northeast Quarter (NE1/4) of Section Nineteen (19), Township Three (3) North, Range Twenty-nine (29) West of the Sixth Principal Meridian, Red Willow County, Nebraska located within the corporate limits of the City of McCook to be known as Bethell Subdivision.
ITEM D Adopt Resolution No. 2007-15 providing for the approval of the final plat of a subdivision of a tract of land being part of the Northeast Quarter (NE1/4) of Section Nineteen (19), Township Three (3) North, Range Twenty-nine (29) West of the Sixth Principal Meridian, Red Willow County, Nebraska located within the corporate limits of the City of McCook to be known as Bethell Subdivision.
ITEM NO. 5  Consent Agenda:
*The Consent Agenda is approved on one motion.  Any item listed on the Consent Agenda may, by the request of any single Councilmember or public in attendance, be considered as a separate item under the Regular Agenda.
ITEM A     Approve the minutes of the August 6, 2007 regular City Council meeting and the August 7, 2007 special City Council meeting.
ITEM B  Approve the McCook Area Chamber of Commerce request to conduct their Annual Heritage Days Parade on public streets on September 29, 2007; for the use of Norris Park for the Annual Heritage Days Arts and Crafts Show and Bandshell Entertainment; the blocking of Norris Avenue from “G” Street to “H” Street, the 700 block of East 1st, the 100 block of East “G” Street and the 100 block of East “H” Street from 5:00 A.M., September 29, 2007 until the evening on September 30, 2007; and the use of Barnett Park from the conclusion of the parade until 4:00 P.M. on September 29, 2007 for a Car Show.
ITEM C   Approve the application for a Special Designated Liquor License submitted by the McCook Area Chamber of Commerce for a mixer to be held at McCook National Bank, 220 Norris Avenue on September 26, 2007 from 5:30 P.M. to 7:30 P.M. 
ITEM D Approve the request from the Quasquicentennial Committee for the use of Norris Park and the bandshell for activities associated with the 125th Birthday Celebration on September 27, 2007.
ITEM E Approve the request from the McCook Balloon Club, LLC to use McCook Regional Airport for the 2007 McCook Balloon Fest on September 7, 8, and 9, 2007.
ITEM F  Receive and file the minutes of the August 13, 2007 Planning Commission meeting.
ITEM G  Accept negotiated bid from Myers Construction Inc. and authorize the Mayor to execute a contract for $41,800.00 for the furnishing and installing of new pumps at the Karrer Park Lift Station.

 REGULAR AGENDA

ITEM NO. 6

Approve Ordinance No. 2007-2796 authorizing and directing the sale and conveyance of the North Fifteen Feet (15') of the South One Half of Lot Two (2), Block Five (5), First Addition to the City of McCook, Red Willow County, Nebraska to Michael D. Gonzales and Michelle L. Gonzales for $1,500.00 upon its second reading.
ITEM NO. 7

Approve Ordinance No. 2007-2797 providing for the adoption of the budget for FY 2007/2008 upon its second reading.
ITEM NO. 8

Approve Ordinance No. 2007-2798 providing for the adoption of the 2007/2008 Fiscal Year Employee Classification Pay Plan upon its second reading.

ITEM NO. 9

Provide direction to the Sales Tax Ballot Committee.
ITEM NO. 10  Presentation regarding LB 701, which taxes property owners and irrigators to bring Nebraska into compliance with the Republican River Compact.
ITEM NO.  11  Executive session for a strategy session with respect to potential litigation - constitutionality of Nebraska Legislatures’s LB 701 taxing proposal.

*If the motion to close passes, then the presiding officer shall announce immediately prior to the closed session:

"At this time, pursuant to the Nebraska Open Meetings Act, a closed session will be held for the purpose of [restate the entire motion].  We will reconvene in public session following this closed session."
ITEM NO.   12  Provide direction to City Staff regarding LB 701 taxing proposal.
ITEM NO.   13  Council Comments.
ITEM NO.   14  Adjournment.
