Call to Order and Roll Call.

*A copy of the Open Meetings Act is posted by the entrance to the Council Chambers and is available for public review.
ITEM NO. 1 Invocation - the McCook Ministerial Association.
ITEM NO. 2 Citizen’s Forum.
*The Council welcomes your input.  You may address the Council at this time on items that are not on tonight’s agenda.
ITEM NO. 3 Mayor’s Announcements & Recognitions.
ITEM NO.  4  Accept the resignation of Marty Conroy as a City Councilmember of the City of McCook.
ITEM NO.  5  Direct the City Clerk to declare that a vacancy exists on the City Council and to publish notice of such vacancy as prescribed by State law.
ITEM NO.  6  Adopt Resolution No. 2007-17 submitting the matter of successor to fill the unexpired term of Marty Conroy on the City Council of the City of McCook, Nebraska, to the statewide general election of November 4, 2008; and certifying the submission of this matter to the Red Willow County Clerk.
ITEM NO. 7  Consent Agenda:
*The Consent Agenda is approved on one motion.  Any item listed on the Consent Agenda may, by the request of any single Councilmember or public in attendance, be considered as a separate item under the Regular Agenda.
ITEM A     Approve the minutes of the August 20, 2007 regular City Council meeting and the August 29, 2007 special City Council meeting.
ITEM B  Receive and file the minutes of the August 7, 2007 Senior Center Advisory Board meting.
ITEM C   Adopt Resolution No. 2007-16 providing for the amendment of Section 5.5 - Leave- E.  Sick Leave and Section 5.5 - Leave- G. Vacation of the City of McCook, Nebraska Employee Handbook amended as of October 2, 2000 changing accruals from monthly to bi-weekly.

 REGULAR AGENDA

ITEM NO. 8

Approve Ordinance No. 2007-2796 authorizing and directing the sale and conveyance of the North Fifteen Feet (15') of the South One Half of Lot Two (2), Block Five (5), First Addition to the City of McCook, Red Willow County, Nebraska to Michael D. Gonzales and Michelle L. Gonzales for $1,500.00 upon its third and final reading.

ITEM NO. 9

Receive and file annual Financial and Cashflow Analyses for the Water Utility and the Sewer Utility Funds as prepared by Public Financial Management, Inc.

ITEM NO. 10

Introduce and approve Ordinance No. 2007-2799 providing for the amendment of Section A of Appendix I of the McCook Municipal Code, 1981 revised; providing for the rates to be charged for water by the McCook Water Department upon its first reading.

ITEM NO. 11

Introduce and approve Ordinance No. 2007-2800 providing for the amendment of Appendix II of the McCook Municipal Code, 1981 revised; providing for the rates to be charged by the McCook Sewer Department upon its first reading.

ITEM NO. 12  Approve Ordinance No. 2007-2797 providing for the adoption of the budget for FY 2007/2008 upon its third and final reading.
ITEM NO.  13  Approve Ordinance No. 2007-2798 providing for the adoption of the 2007/2008 Fiscal Year Employee Classification Pay Plan upon its third and final reading.
ITEM NO.   14  Approve the request for a special exception to allow a breeding kennel in an Agricultural District (AG); applicant - Daniel and Lizann Miller, 71363 Road 385, a tract of land located in the SE1/4NE1/4 of Section 6, Township 2 North, Range 29 West of the 6th P.M., Red Willow County Nebraska; that the granting of the special exception will not adversely affect the public interest; and that satisfactory provisions and arrangements have been made by the applicant concerning Special Exception Considerations a - h.
ITEM NO.   15  Receive update from W Design Associates on the status of Phase I of the "J" Street reconstruction project.
ITEM NO.   16 Confirm Council intention to hold an election on November 6, 2007 for the purpose of consideration of continuing the 1% Sales and Use Tax and initiating an additional ½% Sales and Use Tax for the purpose of additional City-wide projects and Economic Development.
ITEM NO.  17 Executive session for a strategy session with respect to potential litigation - constitutionality of Nebraska Legislatures’s LB 701 taxing proposal.

*If the motion to close passes, then the presiding officer shall announce immediately prior to the closed session:

"At this time, pursuant to the Nebraska Open Meetings Act, a closed session will be held for the purpose of [restate the entire motion].  We will reconvene in public session following this closed session."

ITEM NO.   18 Consider supporting and filing an amicus curiae brief (friend of the court) in support of a "Friends of the River" lawsuit against the State of Nebraska, relating to the imposition of a property tax upon McCook residents in order to meet state requirements to Kansas.
